A couple of weeks ago I posted that I had been cut from glass inside a beer bottle after I had taken a mouthful and asked what I should do.

Anyway, the cut caused an infection and I had to go on antibiotics. The brewery in question offered me a dozen beer....WOW. I told them that this was not satisfactory considering that the glass caused a cut, I could have swallowed it, I had to visit my doctor and I had to bring the bottle and piece of glass to the brewery.

The brewery called today and asked what "I wanted" and I did not know what to answer.

What would you consider adequate compensation for all this trouble?

Time for you to hire a lawyer to help answer that question. The brewery is interested in knowing how much it will cost to avoid a lawsuit.

I'd hold out for a case and a couple of tee shirts. Maybe they'll even throw in a pint glass.

I think what the brewery has offered you is fair. You cut your mouth, no biggie. People get cut every day. There is enough needless litigation in our wonderful country. Don't add to it.

But then again, there's "needful" litigation. Fitz should at least get his medical bills paid. It's the responsibility of the brewer to provide a glass-free product, and nothing short of litigation may teach them that valuable lesson and get them to evaluate their bottling practice to make sure this doesn't happen again. They should be glad they cut somebody easygoing like Fritz.

It would be worth your medical bills paid and a case a month for a year or so (assuming you like the beer).

But...who knows where in the chain of its handling (from bottle factory to brewery to wholesaler to retailer to consumer) it was broken?? Plus, if the guy threw out the bottle and piece of glass, he's got no proof. So, I think the brewery was fair in their offer.

By the way, I doubt that suing the brewery would "teach them a lesson." They'd simply turn the matter over to their insurance company to handle and be done with it, but for any information they'd have to provide to their insurer.
