Labels

Hi, This is a copywright question. I found a perfect *.jpg on the internet for a label for my wine, 36 bottles. It is a painting put up on the internet and the links to the origonal site are broken. Can I use this painting as part of my label? The most this wine will do is to be entered into the local State Fair, and if really good, into the National competition. But I don't want to step on anyones toes or get into copywright problems. Opinions please? Thanks in advance, JAM

My guess (I'm not a lawyer) is that someone, somewhere, does have the copyright to that image. Legally you could not use it. Will you get caught? Good chance that you won't, but that does not relieve you of any obligations. Ed

I do it all the time but they never leave my house or at worse they go to someone in the family but the bottles always come back. Like Ed said, you probably won't get caught but.... you could end up hearing some guy with an ugly label saying "Wow, nice label, I'm telling!" :o)

If you don't feel good about it, then don't. Copywright issues aside, most any image you get off the Internet is going to be probably less than 100 dpi resolution, like 96. What that means is it is going to look fuzzy and amatuerish on your nice label. If you are going to print something the resolution is best up around 300dpi (dots per inch). You generally won't get that without scanning something in yourself.

Why don't you just change the image a little - to make it your own design? You'll feel better for it, as not only have you made the wine but you've also designed the label - obviously being influenced by an existing image, which is what art is all about anyway!

Yeah, blow the pixels up in Paint Shop Pro or something and adjust it around to more like what you want. I'll bet you'll see it is NOT as =perfect= as you thought if you look at it blown up.....

To All that responded,

Thank you to all who advised me about the photo. After reading what you all said, I did further research on the painting and was finally able to contact the painter, a Professor at an Arkansas University. At first he was intruged, but after further consideration, he decided not to give permission. I will respect his wishes. I think I will take my digital camera down to the humane society and find the ugliest mutt possible (preferable a red one)and take a picture of it. Best to all JAM
